Terms of Use for The Activist Lab

Use of the website The Activist Lab (activistlab.bu.edu) (the “Site”) and its contents is subject to the following terms and conditions. Trustees of Boston University (the “University”) operates the Site. As used in these Terms of Use, the terms “we,” “us,” and “our” refer to the University.

Acceptance of These Terms

By using the Site, including but not limited to by viewing or posting content, you accept and agree to be bound by these Terms of Use. By using this Site, you also accept and agree to comply with all applicable University policies, including but not limited to the Conditions of Use and Computing Ethics, as well as all applicable laws, including those prohibiting copyright and trademark infringement. If these Terms of Use are unacceptable to you, do not use the Site.

From time to time, we may change the terms and conditions under which the Site is offered without advance notice, including but not limited to these Terms of Use, by posting such changes online. You are responsible for referring to and complying with updated terms and conditions upon accessing the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the updated terms and conditions.

Your Use

You may use the Site and its contents only for the purposes and in the manner specified in these Terms of Use. You agree to make only non-commercial uses of the Site. You may not distribute, transmit, broadcast, publish, display or otherwise make available Site content, or use Site content for commercial purposes. You agree to use the Site for only lawful purposes, in accordance with applicable laws and University policy, and in a manner that does not infringe or violate anyone’s rights. You shall be solely responsible for your own content submissions and for any consequences of posting or viewing content on this site. If you upload content on the Site, you are responsible for ensuring that you have all rights necessary to upload and disseminate such content. By uploading content to the Site, you (i) grant the University a non-exclusive, worldwide, irrevocable, fully paid, perpetual license to use, reproduce, prepare derivative works of, distribute, display, perform and otherwise make available such content in connection with the Site in any manner or media, and to authorize others to do the foregoing, and (ii) represent and warrant that you have the right to grant us the foregoing rights, and that neither the content nor our use of it as permitted under the foregoing license will infringe or violate anyone’s rights. You agree not to submit or post any content, or engage in any other activity in connection with the Site, that:

  • violates any law or regulation or University policy;
  • infringes anyone’s copyright, patent, trademark or other proprietary rights, or rights of privacy or publicity;
  • is intentionally false or misleading;
  • defames, threatens or harasses anyone;
  • is harmful, dangerous, abusive or offensive;
  • is obscene or contains pornography;
  • contains or utilizes any computer virus, other malicious code, or program that may damage or interfere with the operation of any system, or may unlawfully intercept any data or personal information;
  • contains or consists of advertising or any form of commercial solicitation or activity; or
  • otherwise interferes with the functioning of the Site or other users’ use or enjoyment of the Site.

All elements of the Site architecture, including without limitation the text, software, and graphics, are owned by or licensed to the University, and subject to copyright and other intellectual property rights under United States copyright and trademark laws, and applicable foreign laws. All rights in the Site and the Site’s content that are not expressly granted are reserved. You may use the Site and these elements only in a manner consistent with these Terms.

Copyright and Trademark

Materials uploaded to the Site by other users (“User Content”) may be subject to copyright protections and other posted limitations on usage, reproduction and/or dissemination. You are responsible for honoring such copyrights and adhering to such limitations if you download the materials.

Nothing in these Terms of Use or on the Site should be construed as granting you any right or license to use any trademarks, service marks or logos displayed on the Site. You agree not to use or register any name, logo or insignia of the University or any of its subdivisions for any purpose except with our prior written approval and in accordance with any restrictions required by us.

Review and Removal of Content

Although the University will have no obligation to monitor or take action with respect to User Content, we reserve the right to remove any content that we believe violates the standards stated above or any other provision of these Terms of Use, and to terminate the applicable user’s right to use the Site, in addition to any other rights or remedies available to us. We do not approve or endorse any User Content, and you agree that we will have no responsibility or liability in connection with your use of any such User Content.

The University reserves the right to take down any posting in response to report of abuse, as necessary to investigate alleged violations of University policies, federal, state, or local laws, or the rights of other persons, or otherwise at its discretion at any time and without notice or liability to you.

The University’s policy is to comply with the United States Copyright Act of 1976, as amended (17 U.S.C.) and to combat infringing use and to promote legal alternatives. Applicable Law and Jurisdiction; Access from Outside Massachusetts 

The Site is controlled and operated from Boston, Massachusetts. These Terms of Use, and any claim or dispute that arises from or relates to your use of the Site or its content, are governed by the laws of Massachusetts, without regard to its conflicts of laws principles. You agree that all such claims and disputes will be heard and resolved exclusively in courts sitting in Suffolk County, Massachusetts. You consent to the personal jurisdiction of such courts over you for this purpose, and waive and agree not to assert any objection to such proceedings in such courts (including any defense or objection of lack of proper jurisdiction or venue or inconvenience of forum). If you choose to access our website from locations other than Massachusetts, you are responsible for compliance with all local laws of those other locations.

Children’s Privacy

The Site’s content is not intended to attract children under 13 years of age and we will not knowingly collect personal information from children under 13 years of age. If you are under 13 years of age, you should not use the site.

General

If any provision of these Terms of Use is held to be invalid or unenforceable, that provision, to the extent unenforceable, shall be struck, and shall not affect the validity or enforceability of the remaining provisions. Your rights under these Terms of Use are personal, non-exclusive and non-transferable. Headings are for reference purposes only and in no way define or limit the scope or extent of any provision of these Terms of Use. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. Except as otherwise expressly provided in these Terms of Use, nothing herein shall be deemed to confer any third-party rights or benefits. These Terms of Use set forth the entire understanding and agreement between you and us with respect to the subject matter hereof.

Effective Date
